Terms of Service

1. General Information

Welcome to Outer Surf! These Terms of Service ("Terms") govern the use of our surf school and surf shop services, both online and in-store. By accessing, purchasing, or using our services, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must refrain from using our services.

Outer Surf is a surf school and surf shop, offering surf lessons, surf camps, equipment rentals, retail products, and other services related to surfing.

2. Surf School Terms

2.1. Booking & Reservations

  • All surf lessons must be booked in advance through our website, phone, or in-person at our store.
  • Reservations are subject to availability. We recommend booking early to secure your preferred time and date.
  • Customers have the option of full refund or option to reschedule within 24 HOURS OF BOOKING, as long as the booking is made 48 hours or more prior to the scheduled activity.

2.2. Cancellation

Cancellation by Customer:

  • Within 24 hours of booking: Full refund or option to reschedule, as long as the booking is made 48 hours or more prior to the scheduled activity.
  • Up to 24 hours before the scheduled activity: 75% refund or option to reschedule. A 25% booking fee to reserve your spot will not be refunded.
  • Less than 24 hours before the scheduled activity: No refund.

Cancellation by the Business:

  • If we need to cancel the activity due to unforeseen circumstances, hazardous weather, or dangerous surf conditions, you will receive the choice of a credit, a full refund, or the option to reschedule.

No-Show Policy:

  • If you do not show up for your scheduled activity, no refund will be issued.

Interruption During Lesson:

  • If hazardous weather or surf conditions arise during the lesson:
    • Cancellation within 30 minutes results in a 66% refund.
    • Cancellation between 30 and 60 minutes results in a 33% refund.
    • If 1 hour or more of the lesson has been completed, the lesson is considered complete.
    • If less than 1 hour of the lesson has been completed, we will either reschedule the remaining time or issue a partial refund:

When you book with us, we are reserving your spot and we expect you to adhere to the schedule of your reservation.

2.2. Payment

  • Full payment is required at the time of booking for surf lessons and camps.
  • Payments can be made via credit card, debit card, or other payment methods accepted by Outer Surf.

2.3. Age and Skill Requirements

  • All Participants must know how to swim and be comfortable in the water.
  • All participants must be at least 8 years old to enroll in group lessons or 6 for private lessons.
  • All participants must be at least 8 years old to enroll in Surf Camps.
  • Surf lessons are available for all skill levels, from beginners to advanced surfers. Please ensure you book a lesson that matches your skill level.

2.4. Waivers and Liability

  • All participants must sign a liability waiver before taking part in any surf related activities or clinics.
  • The waiver will release Outer Surf from liability in the event of injury, loss, or damage while participating in our surf lessons or activities.
  • It is the responsibility of the participant (or guardian, if the participant is a minor) to ensure they have the physical fitness to participate safely in the lesson.

2.5. Weather and Safety Conditions

  • All lessons are subject to weather and surf conditions. Outer Surf reserves the right to cancel or reschedule lessons due to unsafe conditions. If a lesson is canceled due to weather or safety concerns, you will be offered a full refund or the option to reschedule the lesson.

2.6. Equipment and Safety

  • We provide all necessary surf equipment for lessons, including surfboards, wetsuits, and leashes.
  • Participants must use all provided safety equipment, including helmets and life jackets if required, during the lesson. Failure to do so may result in the participant being excluded from the session for safety reasons.

2.7. Code of Conduct

  • We expect all participants to act respectfully toward instructors, other students, and staff. Misbehavior, unsafe conduct, or failure to follow safety instructions may result in dismissal from the lesson without a refund.

3. Surf Shop Terms

3.1. Products

  • Outer Surf sells a variety of surfing equipment and apparel, including surfboards, wetsuits, accessories, and more. All products are subject to availability.
  • Product descriptions, specifications, and prices are provided to the best of our knowledge but may be subject to change without notice.

3.2. Pricing and Payment

  • Prices for products and services are as listed on our website and in-store at the time of purchase.
  • We accept payment via credit cards, debit cards, and other approved payment methods.

3.3. Returns and Refunds

  • Please refer to our Returns and Refunds Policy for information on how to return or exchange items purchased from the surf shop.
  • Refunds for defective products will be issued based on our inspection. Non-defective items are subject to the standard return policy conditions (e.g., unopened, unused).

3.4. Equipment Rentals

  • Surfboards, wetsuits, and other surf equipment are available for rental at the Outer Surf shop.
  • Rentals are subject to availability and must be returned in the condition in which they were issued.
  • Renters are responsible for the equipment during the rental period. Any lost, stolen, or damaged equipment will incur replacement fees, as determined by Outer Surf.

3.5. Gift Cards

  • Outer Surf offers gift cards for purchase. Gift cards are non-refundable and cannot be exchanged for cash.
  • Gift cards may only be used for services at the Outer Surf. Services include Surf Lesson, Surf Camps, Surf Retreats and Surf Clinics.

4. General Terms

4.1. Privacy and Data Protection

  • By using our services, you agree to the collection and use of personal information as outlined in our Privacy Policy.
  • We are committed to protecting your privacy and complying with applicable data protection laws.

4.2. Limitation of Liability

  • Outer Surf shall not be held liable for any indirect, incidental, special, or consequential damages arising from the use of our services or products.
  • In no event shall Outer Surf's liability exceed the total amount paid for the services or products in question.

4.3. Intellectual Property

  • All content provided by Outer Surf, including logos, designs, and trademarks, are owned by Outer Surf and protected by intellectual property laws. Unauthorized use of this content is prohibited.

4.4. Modification of Terms

  • Outer Surf reserves the right to amend or update these Terms of Service at any time. Changes will be posted on this page, and the revised Terms will become effective immediately upon posting.

4.5. Governing Law

  • These Terms of Service are governed by the laws of North Carolina, USA, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the appropriate courts located within North Carolina, USA.
